Terms of service

These Terms of Use (hereinafter referred to as the "Terms") set forth the conditions for using the online shop (hereinafter referred to as the "Service") provided by hinoki kagawa (hereinafter referred to as the "Company") on this website. Registered users (hereinafter referred to as "Users") shall use the Service in accordance with these Terms.


Article 1 Application

These Terms shall apply to all relationships between the User and the Company regarding the use of the Service.
In addition to these Terms, the Company may establish various rules and regulations (hereinafter referred to as "Individual Provisions") regarding the use of the Service. Regardless of their names, these Individual Provisions shall constitute a part of these Terms.
If any provision of these Terms conflicts with any provision of the Individual Provisions, the provisions of the Individual Provisions shall prevail unless otherwise specified.


Article 2 User Registration

In the Service, user registration shall be completed when an applicant agrees to these Terms, applies for registration in the manner prescribed by the Company, and the Company notifies the applicant of its approval.
The Company may not approve an application for registration if it determines that the applicant falls under any of the following, and shall have no obligation to disclose the reasons.

  • If false information is provided in the registration application.
  • If the applicant has previously violated these Terms.
  • If the Company otherwise deems the registration inappropriate.

Article 3 Management of User ID and Password

Users shall manage their User ID and password for the Service at their own responsibility.
Users may not, under any circumstances, transfer or lend their User ID or password to a third party, or share them with a third party.
If a combination of User ID and password matches the registered information and is used to log in, the Company will regard it as use by the registered User.
The Company shall not be liable for any damages arising from the use of the User ID and password by a third party, except in cases of intentional misconduct or gross negligence by the Company.


Article 4 Sales Contract

In the Service, a sales contract is concluded when a User makes a purchase application to the Company and the Company notifies the User of its acceptance. Ownership of the product shall transfer to the User when the Company hands the product over to the delivery company.
The Company may cancel the sales contract without prior notice to the User if the User falls under any of the following.

  • If the User violates these Terms.
  • If delivery cannot be completed due to unknown address or prolonged absence.
  • If the Company deems that the trust relationship between the Company and the User has been damaged.

The payment methods, delivery methods, cancellation procedures, and return procedures for the Service shall be determined separately by the Company.


Article 5 Intellectual Property Rights

The copyrights and other intellectual property rights to product photos and other content (hereinafter referred to as "Content") provided through the Service belong to the Company or other legitimate rights holders. Users may not reproduce, reprint, modify, or otherwise make secondary use of such Content without permission.


Article 6 Prohibited Acts

Users shall not engage in any of the following acts when using the Service

  • Acts that violate laws or public order and morals.
  • Acts related to criminal conduct.
  • Acts that infringe copyrights, trademarks, or other intellectual property rights contained in the Service.
  • Acts that destroy or interfere with the functions of the Company’s servers or networks.
  • Acts of commercially using information obtained through the Service.
  • Acts that may interfere with the operation of the Company’s services.
  • Acts of unauthorized access or attempts thereof.
  • Acts of collecting or accumulating personal information about other Users.
  • Acts of impersonating other Users.
  • Acts of providing benefits, directly or indirectly, to antisocial forces in connection with the Company’s services.
  • Any other acts that the Company deems inappropriate.

Article 7 Suspension of Service Provision, etc.

The Company may suspend or interrupt all or part of the Service without prior notice to Users if it determines that any of the following applies.

  • When performing maintenance or updates of the computer system related to the Service.
  • When it becomes difficult to provide the Service due to force majeure such as earthquakes, lightning, fire, power outages, or other natural disasters.
  • When computers or communication lines are stopped due to accidents.
  • When the Company otherwise determines that it is difficult to provide the Service.

The Company shall not be liable for any disadvantage or damage suffered by Users or third parties due to the suspension or interruption of the Service, regardless of the reason.


Article 8 Usage Restrictions and Deregistration

The Company may, without prior notice, restrict the use of all or part of the Service or cancel the registration of a User if any of the following applies.

  • If the User violates any provision of these Terms.
  • If it is found that there are false facts in the registration information.
  • If the credit card provided by the User as a payment method is suspended.
  • If there is a default in payment obligations such as fees.
  • If there is no response to communications from the Company for a certain period.
  • If there is no use of the Service for a certain period since the last use.
  • If the Company otherwise deems the use of the Service inappropriate.

The Company shall not be liable for any damages incurred by the User as a result of actions taken by the Company under this Article.


Article 9 Withdrawal

Users may withdraw from the Service by following the prescribed withdrawal procedures.


Article 10 Disclaimer of Warranty and Limitation of Liability

The Company does not guarantee that the Service is free of factual or legal defects (including defects, errors, bugs, or infringements relating to safety, reliability, accuracy, completeness, validity, fitness for a particular purpose, or security).
The Company shall not be liable for any damages incurred by Users arising from the Service. However, if a contract (including these Terms) between the Company and a User regarding the Service constitutes a consumer contract under the Consumer Contract Act, this exemption shall not apply, but even in such a case, the Company shall not be liable for damages arising from special circumstances (including cases where the Company or the User foresaw or could have foreseen the occurrence of damages) due to default or tort by the Company (excluding gross negligence).
The Company shall not be liable for any transactions, communications, or disputes that arise between Users or between a User and a third party in connection with the Service.


Article 11 Changes to Service Content, etc.

The Company may change the content of the Service or discontinue providing the Service without notice to Users and shall not be liable for any damages incurred by Users as a result.


Article 12 Amendment of Terms of Use

The Company may amend these Terms at any time without notice to Users if it deems it necessary. If a User starts using the Service after the Terms have been amended, the User shall be deemed to have agreed to the amended Terms.


Article 13 Handling of Personal Information

The Company shall properly handle personal information obtained through the use of the Service in accordance with the Company’s Privacy Policy.


Article 14 Notices and Communications

Notices or communications between Users and the Company shall be made in the manner specified by the Company. Unless a User submits a change notification in accordance with a method separately specified by the Company, the Company will consider the currently registered contact information to be valid and send notices or communications to such contact information, which shall be deemed to have reached the User at the time of dispatch.


Article 15 Prohibition of Assignment of Rights and Obligations

Users may not assign or pledge their contractual status under the Service or their rights or obligations under these Terms to a third party without the prior written consent of the Company.


Article 16 Governing Law and Jurisdiction

The interpretation of these Terms shall be governed by the laws of Japan. The United Nations Convention on Contracts for the International Sale of Goods shall not apply to the Service.
In the event of any dispute arising in relation to the Service, the court having jurisdiction over the location of the Company’s head office shall have exclusive jurisdiction.
